Welcome to The Kitchen Depot (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of https://kitchendepot.store/ (the “Site”) and any purchase you make from us.

By visiting the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy and Policies (Shipping, Returns & Refunds, etc.), which are incorporated by reference. If you do not agree, please do not use the Site.

1) Eligibility & Your Account

  • Eligibility. You must be at least 13 years old to use the Site and at least 18 to purchase. If you use the Site on behalf of another person or entity, you represent you have authority to bind that person or entity to these Terms.

  • Account security. If you create an account, you are responsible for maintaining its confidentiality and for all activity under it. Notify us immediately of any unauthorized use.


2) How Our Store Operates (Automated Dropship Fulfillment)

  • Direct-to-you shipping. We partner with vetted U.S. and international suppliers/warehouses. Orders may be fulfilled and shipped directly from these partners.

  • Auto-forwarding. When you place an order, our system may automatically forward your order details to the relevant supplier so your goods ship as quickly as possible.

  • Multiple parcels. Items in one order may ship separately and arrive at different times.

  • Availability. If an item becomes unavailable after purchase, we may offer an alternative, backorder, or prompt refund.


3) U.S.–Only Shipping (No International Shipping)

We currently ship within the United States only. We do not ship internationally at this time. Shipping options, fees, and estimated timelines are shown at checkout and described on our Shipping Policy page.


4) Orders, Pricing & Payment

  • Order acceptance. Your order is an offer to buy. We may accept or reject any order. Acceptance occurs when we send a shipping confirmation or otherwise fulfill your order.

  • Processing time. Typical processing is 1–3 business days before shipment. Peak seasons may add 1–2 business days.

  • Payment methods. We accept major cards and other methods shown at checkout. Payment is processed securely by our payment providers; we do not store full card numbers.

  • Taxes. Where required by law, applicable sales tax will be collected at checkout.

  • Price changes & errors. Prices are in USD and may change without notice. We may cancel and refund any order affected by pricing, availability, or typographical errors.

  • Promotions. Promotions/coupons may have specific terms and cannot be applied retroactively or combined unless stated. If a return breaks a bundle/BOGO condition, refunds will reflect the standalone price of retained items.


5) Shipping, Risk of Loss & Delivery Issues

  • Estimates. Carrier estimates are not guarantees; weather, carrier delays, peak periods, and other factors can affect delivery times.

  • Tracking. We email tracking when available. If you do not receive it, check spam or contact us.

  • Address accuracy. You are responsible for providing a complete, accurate shipping address. Orders delivered to the address provided are deemed fulfilled. If a parcel returns due to an incorrect/undeliverable address, reshipping fees may apply.

  • Risk of loss. Title and risk of loss transfer to you upon delivery to your address as reflected by the carrier’s delivery scan.

  • Lost/late packages. If tracking shows “delivered” but you did not receive it, please check with household members, neighbors, and your local carrier office. If not located within 3 business days, contact us; we will open a trace and assist. Where a carrier confirms loss, we’ll reship or refund.


6) Returns, Refunds & Exchanges

Please review our Returns & Refunds Policy (incorporated by reference). Key points:

  • Return window. Most items can be returned within 15 days of delivery with an RMA (Return Merchandise Authorization) from us.

  • Eligibility. Items must be unused, undamaged, and in original packaging with all inserts/accessories.

  • Hygiene. For food-contact items (e.g., platters, cutters, containers), the item must be unused and unopened.

  • Defective or damaged. Report within 7 days of delivery with photos/video; we will replace or refund promptly.

  • Return shipping. If the item is defective, damaged, or incorrect, we cover it (or apply a “keep-it” resolution for low-value items at our discretion). For change-of-mind returns, you are responsible for return shipping.

  • Exchanges. The fastest method is to place a new order and request a return of the original.

  • Refund method. Refunds are issued to the original payment method after inspection; banking timelines vary.


7) Product Information, Safety & Natural Variations

  • Descriptions. We work to ensure accurate descriptions and imagery. Minor variations in color/texture can occur due to lighting, screens, and—where applicable—natural materials (e.g., bamboo). These variations are not defects.

  • Care & use. Always follow any care/cleaning instructions on the product page or packaging (e.g., hand-wash wood/bamboo; top-rack dishwasher only if specified).

  • Food safety. We partner with suppliers who provide material compliance for food-contact items. Wash before first use.

  • No medical or professional advice. Content on the Site is informational only and not a substitute for professional advice.


8) Intellectual Property

All content on the Site—including text, graphics, logos, photos, videos, icons, and software—is owned by or licensed to The Kitchen Depot and protected by U.S. and international IP laws. You may not copy, reproduce, modify, distribute, display, or create derivative works without our prior written consent.


9) User Content (Reviews, Photos, Submissions)

If you post or submit reviews, photos, or other content (“User Content”):

  • You grant The Kitchen Depot a non-exclusive, royalty-free, worldwide license to use, reproduce, display, distribute, and create derivative works of your User Content in connection with the Site, marketing, and social media, with attribution where feasible.

  • You represent that you own or control the rights to your User Content and that it does not infringe any third-party rights or contain unlawful, harmful, or misleading material.

  • We may remove or refuse any User Content at our discretion.


10) Acceptable Use & Prohibited Conduct

You agree not to:

  • Use the Site for unlawful purposes or in violation of any law.

  • Interfere with or disrupt the Site or its security features.

  • Use any automated means to access the Site (scrapers, bots) without permission.

  • Misrepresent your identity or affiliation, or attempt to commit fraud or chargeback abuse.

  • Reverse engineer, copy, or resell our content, listings, or pricing at scale.
    We may suspend or terminate access for violations.


11) Third-Party Services & Links

The Site may link to third-party websites or use third-party services (e.g., payment processors, analytics, shipping carriers). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to those parties’ terms.


12) Electronic Communications & Consent

By using the Site or emailing us, you consent to receive communications from us electronically (e.g., emails, order confirmations, transactional notices). If you opt in to marketing, you may unsubscribe at any time via the link in our emails.


13) Disclaimers

  • “As-is” Site. The Site and its content are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

  • Availability. We do not guarantee the Site will be uninterrupted, error-free, secure, or free of viruses.

  • Products. Except as stated in our policies or a manufacturer’s limited warranty (if any), products are provided without additional warranties. Normal wear and tear, misuse, or improper care are not covered.


14) Limitation of Liability

To the maximum extent permitted by law, The Kitchen Depot, its owners, employees, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Site or purchase of products.

In all cases, our total liability for any claim shall not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the fullest extent permitted.


15) Indemnification

You agree to defend, indemnify, and hold harmless The Kitchen Depot and its affiliates from any claims, liabilities, damages, judgments, awards, losses, costs, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your misuse of the Site or products.


16) Force Majeure

We are not responsible for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, supply chain disruptions, carrier delays, epidemics, government actions, or internet outages.


17) Governing Law; Dispute Resolution

  • Governing law. These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles.

  • Informal resolution. Before filing a claim, please email us at contact@kitchendepot.store so we can try to resolve it quickly.

  • Venue. Subject to applicable law, you agree to the exclusive jurisdiction and venue of state and federal courts located in Los Angeles County, California for any dispute not subject to informal resolution or small-claims court.

If you prefer to include binding arbitration and a class-action waiver, let me know and I’ll add a compliant clause.


18) Termination

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms. Provisions that by their nature should survive (e.g., IP, disclaimers, limitation of liability, indemnity) will survive termination.


19) Changes to the Site & to These Terms

We may update the Site and these Terms from time to time. Changes are effective when posted to the Site with the “Last updated” date revised. Your continued use after changes means you accept the updated Terms.


20) Assignment

You may not assign any rights or obligations under these Terms without our prior written consent. We may assign our rights/obligations in connection with a merger, acquisition, or sale of assets.


21) Severability; Waiver; Entire Agreement

If any provision is found unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver. These Terms, together with our incorporated policies, are the entire agreement between you and us regarding the Site and your purchases.
